Welcome to htts://bookiful.net (the “Website”), provided by Sofoklis Archontakis (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of the Website and our book cover design services (“Services”). By accessing and using our Website and Services, you agree to comply with and be bound by the following Terms, conditions, and processes. If you disagree, please refrain from using the Website or Services.
1.1 Service Description: We offer custom book cover design services. Our Services include, but are not limited to, the creation of digital book cover designs, revisions, and delivery of final designs in specified formats.
1.2 Eligibility: You must be at least 18 years old to use our Services. By using our Services, you confirm that you meet this requirement.
1.3 Changes to Terms: We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our Services after any changes constitutes acceptance of the new Terms.
2.1 Placing Orders: All orders for book cover design services must be placed via email. Communication regarding revisions, approvals, and final delivery will also be conducted through email.
2.2 Order Submission: Clients must submit all necessary materials, required information, including book title, author name, genre, design preferences, format, dimensions, and any other specific instructions, at the time of placing an order.
2.3 Payment: 50% of the order’s payment amount is required at the time of order submission, while the rest 50% is required at the time of the finished design delivery. We accept payments via PayPal and direct bank transfer (BACS).
2.4 Order Confirmation: Once the initial payment is received, you will receive an order confirmation via email. This confirmation will include details of your order and the estimated delivery time.
3.1 Initial Design: We will provide an initial book cover design based on the information you provided. This design will be sent to you for review within 5-7 business days.
3.2 Revisions: We offer 3 free revisions to the initial design. Each revision will be completed and sent to you for review within 3-5 business days. Any additional revisions beyond this will incur an extra fee of $50 per hour. Revisions are limited to adjustments or modifications of the existing design concept. Requests for a completely new design concept may be treated as a separate project and may incur additional fees.
3.3 Final Approval: Upon final approval, the completed design will be delivered in JPEG and PDF formats.
4.1 License to Use: Upon full payment, the client is granted a non-exclusive, non-transferable, and non-sublicensable license to use the final book cover design solely for its intended purpose as a book cover, as well as for promotional and marketing purposes directly related to the book (e.g., on mockups, social media graphics, advertisements). The client is expressly prohibited from altering, modifying, or manipulating the design in any way for the purpose of creating derivative works, including but not limited to using the design to create another book cover or any other visual work. Additionally, the client may not provide the design to third parties, including other designers, for the purpose of creating lookalike or derivative designs.
4.2 Third-Party Resources: If the design incorporates third-party stock images, fonts, or other resources, the client is responsible for ensuring compliance with the licensing terms of those resources.
5.1 Client-Initiated Cancellations: Clients may cancel their project at any time after it has been booked to our schedule.
5.2 Refund Policy: If clients cancel their order at any time before the design process has begun, a full refund will be issued. However, if the cancellation occurs after the design process has started but before the final design is delivered, no refunds will be issued. In the event that a refund is processed, we will retain all rights, ownership, and any associated copyrights to any designs, drafts, and original artwork created up until the point of cancellation.
5.3 Refund Requests: All refund requests must be submitted in writing via email to contact@bookiful.net and are subject to our evaluation.
5.4 Order Cancellation by Us: We reserve the right to cancel any order at our discretion. If we cancel an order, a full refund will be provided.
6.1 Accurate Information: Clients must provide accurate and complete information when placing an order. We are not responsible for any delays or errors resulting from incorrect information provided by the client.
6.2 Feedback and Communication: Timely feedback and communication are essential for the smooth completion of the design process. Delays in providing feedback may result in delays in delivery.
6.3 Design Review and Proofing: The client is responsible for reviewing and proofing the final book cover design prior to its use for publication or promotional purposes. The client must notify us of any errors or required corrections within a reasonable period after receiving the final design. Additional fees may apply for any changes or corrections requested after the design has been completed and approved.
6.4 Materials and Licensing: We ensure that all elements used in the book cover design, including images, illustrations, and fonts, are either created by us, royalty-free, or used under valid licenses for commercial purposes. If the client provides any materials for inclusion in the design, it is the client’s responsibility to ensure those materials are properly licensed and authorized for use. We shall not be liable for any legal claims, costs, or damages arising from the use of materials provided by the client without appropriate permissions.
6.5 Attribution: To credit us as the designer of the book cover, please include the following attribution on the book’s copyright page: “Book Cover Design by Bookiful.net.”
7.1 Viruses and Damage: We are not responsible for any damage to your computer system, loss of data, or other harm that may result from accessing, downloading, or otherwise using our Services. We do not guarantee that our Website, servers, or any emails sent from us are free from viruses, malware, or other harmful components.
7.2 No Guarantees: While we strive to deliver high-quality designs, we do not guarantee specific results or outcomes from using our Services.
7.3 Liability: We shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our Services.
7.4 Indemnification: You agree to indemnify, defend, and hold harmless Sofoklis Archontakis, our officers, directors, employees, and agents, from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from your use of our Services, your violation of these Terms and conditions, or your infringement of any intellectual property or other rights of any third party.
These Terms and conditions are governed by and construed in accordance with the laws of Greece. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Greece, specifically the courts of Heraklion.
Any disputes related to these Terms, the Website, or the Services must first be addressed through good faith negotiations. If these negotiations do not resolve the dispute, either party may seek resolution through the courts in Heraklion, Greece.
10.1 Confidentiality: Both parties agree to keep any proprietary information, trade secrets, or sensitive data confidential. This obligation remains in effect even after the termination of this agreement, unless the information becomes publicly available through no fault of the receiving party.
10.2 Privacy Policy: Our Privacy Policy, which is part of these Terms, outlines how we protect your personal data. By using our Services, you consent to our Privacy Policy.
11.1 Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, labor disputes, or interruptions in internet service. If such an event occurs, we will notify you and make reasonable efforts to resume our Services as soon as possible.
12.1 Severability: If any provision of these Terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.
13.1 Entire Agreement: These Terms and conditions, along with any other legal notices and agreements published by Sofoklis Archontakis on this website, constitute the entire agreement between you and us concerning the use of our Services. They supersede any prior agreements, whether oral or written, between you and us.
14.1 Termination by Us: We reserve the right to terminate or suspend your access to our Services at any time, without notice, for conduct that we believe violates these Terms and conditions, is harmful to other users of the service, or is illegal.
14.2 Termination by Client: You may terminate your use of our Services at any time by notifying us in writing. However, such termination will not entitle you to a refund except as provided in our Refund Policy.
15.1 By using our Website and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and conditions.
